These Terms and Conditions (the "Terms") govern your access to and use of the websites, dashboard, applications, features, functions and channels operated by Bitopen Inc., a company incorporated in the British Virgin Islands ("AiXFunded", "Company", "we", "us", or "our").

By accessing each and every time the aforesaid websites, dashboard, applications, features, functions and channels (the "Platform"), or otherwise using the Services, you acknowledge that you have read, understood and agree to be bound by these Terms.

These Terms should be read together with the Privacy Policy, Disclaimer, Program Rules, and any other agreement or document as may be applicable to you as you access the Platform and/or use the Services. If you do not agree to these Terms, you must not access the Platform or use the Services.

AiXFunded is a crypto-native proprietary trading evaluation and trader development platform. The Services allow users to purchase or participate in simulated trading Challenges.

AiXFunded is not a broker, exchange, investment adviser, financial adviser, asset manager, fund manager, bank, custodian, money transmitter, payment institution or deposit-taking institution. AiXFunded does not provide financial, investment, legal, tax or trading advice.

All Evaluation Accounts, Challenge accounts and trading balances are simulated unless expressly stated otherwise in writing by AiXFunded. No user owns, controls or receives any right, title or interest in AiXFunded capital, treasury assets, simulated balances or trading infrastructure by using the Services.

The Services are provided for evaluation, training, skill assessment, community and educational purposes. Your participation does not create an investment relationship, managed account, securities account, derivatives account, brokerage relationship, deposit relationship, fiduciary relationship or advisory relationship.

AiXFunded's trading environment, dashboard, Challenge accounts, and Evaluation Accounts are not an exchange, broker, regulated market, trading venue or venue for executing real customer trades. They are provided solely as part of AiXFunded's proprietary evaluation, simulated trading, risk management and program administration environment.

Any prices, balances, trades, account values, profit calculations, loss calculations, drawdown calculations, AI Agent outputs, risk scores or other metrics displayed through the Services are provided for evaluation, simulation, internal accounting, risk review and program administration purposes only.

Certain simulated instruments available through the Services may reference the price or performance of publicly traded equities, exchange-traded funds or other traditional financial assets, including through virtual asset derivative products. Such simulated instruments do not constitute actual securities, tokenized securities, security tokens, fractional shares or any ownership interest in the underlying assets.

For the avoidance of doubt, unless the context otherwise requires, any reference in these Terms to "trade", "trading", "position", "order" or similar terminology refers solely to simulated trading activities conducted within the Services and does not refer to the purchase, sale or execution of any actual securities, virtual assets, derivatives or other financial instruments.

To use the Services, you represent and warrant that:

• you are at least 18 years old and of legal age in your jurisdiction;
• you have full legal capacity and authority to enter into these Terms;
• you are not located in, resident in, a citizen or national of, incorporated in, established in or operating from a Restricted Jurisdiction;
• you are not subject to sanctions, embargoes, asset freezes or trade restrictions administered by the United Nations, United States, European Union, United Kingdom, British Virgin Islands or any other applicable authority;
• your use of the Services is legal in your jurisdiction and does not violate any contract, law, regulation, court order, sanctions rule or third-party right;
• you will use the Services only for yourself and not on behalf of any undisclosed person or entity.

AiXFunded may refuse, suspend or terminate access to the Services at any time if it determines that you are not eligible or that your continued access creates legal, compliance, security, reputational or business risk.

AiXFunded does not offer, provide or make available the Services to any person or entity that is located in, resident in, a citizen or national of, incorporated in, established in or operating from a Restricted Jurisdiction.

Restricted Jurisdictions include any jurisdiction subject to comprehensive or material sanctions, embargoes or trade restrictions, any jurisdiction where use or provision of the Services may violate applicable law or vendor requirements, and any jurisdiction determined by AiXFunded in its sole discretion to be restricted.

Without limiting the foregoing, Restricted Jurisdictions may include the United States, United Kingdom, Canada, Russia, Belarus, Myanmar, Cuba, Iran, North Korea, Syria, Crimea, Donetsk, Luhansk, Venezuela, Sudan, South Sudan, Somalia, Democratic Republic of the Congo, Central African Republic, Libya, Lebanon, Iraq, Afghanistan, Yemen, Zimbabwe, Haiti, Eritrea, Ethiopia, Nicaragua and any OFAC-sanctioned jurisdiction, as updated from time to time.

AiXFunded may use IP addresses, wallet addresses, Telegram accounts, X accounts, self-declarations, payment data, device or browser signals, trading patterns, referral patterns, blockchain analytics, third-party risk tools and other information to assess jurisdictional eligibility and risk.

You must not use VPNs, proxies, private relays, shared devices, third-party identities, inaccurate declarations or other methods to bypass jurisdictional restrictions. If AiXFunded determines that you have misrepresented your location, nationality, residency, citizenship or eligibility, AiXFunded may terminate your account, deny rewards, deny payouts, deny affiliate commissions, cancel access and refuse refunds.

You may be required to register using an email address, connect a wallet, and verify your Telegram account and X account. AiXFunded may collect and process information including wallet addresses, email addresses, Telegram user ID, Telegram username, Telegram display name, Telegram avatar, Telegram group membership or related metadata, X handle, X user ID, X profile URL, follower or public profile information, public posts, IP address, payment records and trading records.

Telegram and X verification is used for account integrity, fraud prevention, duplicate account prevention, community management, affiliate attribution, support, risk review and communication. Telegram and X verification does not mean AiXFunded has verified your legal identity.

You must provide accurate and complete information and keep your account information current. You are responsible for maintaining the security of your wallet, credentials, devices, Telegram account, X account and email account.

One Telegram account and one X account may be bound to only one AiXFunded user account unless AiXFunded expressly approves otherwise. You must not sell, rent, transfer, share or permit another person to use your account.

AiXFunded may request enhanced verification at any time, including before processing payouts, processing performance rewards, processing affiliate commissions, investigating suspected abuse or complying with law or sanctions requirements. Enhanced verification may include identity documents, proof of address, wallet ownership proof, source-of-funds information, tax information, sanctions screening, KYB information or other materials.

AiXFunded may maintain an internal Account Balance for your purchases, rewards, affiliate commissions, performance rewards and payouts. The Account Balance is an internal ledger record only and does not represent a bank account, deposit account, regulated stored-value facility, custody account, segregated account, client money account, margin account, trading account or claim to any specific wallet asset.

Any amount added to your Account Balance constitutes a prepayment for, and purchase of, non-transferable platform credits that may be used solely to purchase or access AiXFunded products, Challenges, Services and other platform features made available by AiXFunded from time to time.

Such platform credits are not deposits, client money, stored value, electronic money, payment accounts, trading funds, margin, custody assets or funds held by AiXFunded on your behalf. Platform credits have no independent cash value, are not redeemable except as expressly permitted by AiXFunded, and do not represent any ownership, beneficial interest or claim over any fiat currency, digital assets or other property held by AiXFunded.

In the event of AiXFunded's bankruptcy, insolvency, restructuring, suspension of operations, liquidation, security incident, treasury loss or other financial distress, any unused service credit or unpaid reward, commission, bonus, payout, or other amount shown in your AiXFunded account may be subject to delay, reduction, cancellation, loss, restructuring or treatment as an unsecured claim, to the maximum extent permitted by applicable law.

Users may purchase platform credits by transferring supported digital assets using the methods and blockchain networks supported by AiXFunded from time to time. Upon confirmation of the transfer, AiXFunded may credit the corresponding amount of platform credits to the user's Account Balance in accordance with its internal policies. AiXFunded may change supported assets and networks at any time.

Digital asset transfers are irreversible and subject to blockchain network risks. You are solely responsible for using the correct chain, token contract, wallet address, memo or tag if applicable. AiXFunded is not responsible for transfers sent to an incorrect address, wrong network, unsupported token, malicious contract, compromised wallet or incompatible wallet.

AiXFunded may offer different Challenge types, including Lite Mode, Standard Mode, Boost Mode, manual trading variants and AI Agent variants. Each product may have different fees, eligibility requirements, profit targets, loss limits, drawdown rules, effective trading day requirements, time limits, payout eligibility, reward rules, account sizes and other conditions.

Your purchase of a Challenge gives you access to the relevant evaluation product and simulated trading environment, not to real capital, a brokerage account, custody services or investment returns. Challenge Fees are paid for access to the evaluation product and related services.

The Program Rules form an integral part of these Terms. Certain operational, trading, product, risk management, payout and other programme-specific requirements are set out in the applicable Program Rules, product pages or other official communications published by AiXFunded from time to time.

AiXFunded may update, modify, discontinue, rename, reprice, suspend or replace any Challenge, product, account type, rule, fee, reward, bonus, payout condition or program at any time. Unless required by law, AiXFunded is not obligated to continue offering any product or feature.

AiXFunded reserves the right to interpret, apply and enforce these Terms, the Program Rules and all applicable product rules. AiXFunded may reject or cancel trades, adjust account results, invalidate Challenge progress, force-close positions, restrict trading functionality, suspend or terminate accounts, delay, reduce or deny payouts, cancel rewards or bonuses, require additional verification, or take any other action reasonably necessary to administer its programmes and protect the integrity of the Services.

AiXFunded may, but is not obligated to, provide detailed reasons, evidence or internal analysis for rule enforcement decisions, particularly where disclosure may compromise fraud prevention, risk controls, security systems, internal review methods, third-party rights or platform integrity.

You must trade only in your own account, using your own independent judgment, and must comply with these Terms and the Program Rules.

Unless expressly permitted by AiXFunded in writing, each position must be held for at least sixty (60) seconds. Positions opened and closed within less than sixty (60) seconds may be treated as prohibited high-frequency, latency-based, or exploitative trading.

The following conduct is prohibited:

• account sharing, account selling, password sharing, third-party account management, or allowing another person to trade for you;
• copy trading, group trading, coordinated trading, mirror trading, or trading substantially similar positions across multiple accounts;
• HFT, latency arbitrage, stale price arbitrage, quote stuffing, error exploitation, platform manipulation, or any strategy relying on speed, delay, mispricing, or system defects;
• insider trading, front-running, market manipulation, wash trading, spoofing, layering, or other abusive market behavior;
• overleveraging, excessive exposure, one-sided bets, account rolling, hedging, arbitrage, martingale, grid trading, or strategies designed to bypass risk management, drawdown, consistency, payout, or account rules;
• using bots, algorithms, scripts, trade copiers, signals, or AI agents unless expressly authorized by AiXFunded;
• using VPNs, proxies, VPS, shared devices, or similar tools to misrepresent location, identity, account ownership, eligibility, or jurisdiction;
• creating duplicate, fake, linked, related-party, or synthetic accounts for challenge, bonus, reward, commission, referral, or payout abuse.

"Abusive Trading Practices" means any trading activity that deviates from standard market practices, creates a reasonable risk of financial, operational, technical, regulatory, reputational, or other harm to AiXFunded, or violates the spirit of fair trading and platform integrity.

You must not knowingly or unknowingly use, benefit from, or fail to report any error, vulnerability, delay, mispricing, data issue, calculation error, latency, malfunction, or unintended behavior in AiXFunded's Services, trading environment, pricing feeds, dashboards, risk systems, payout systems, AI Agent systems, or third-party infrastructure.

AiXFunded has sole discretion to determine whether any trade, strategy, account pattern, referral pattern, payout request, or user conduct violates these Terms or the Program Rules. If AiXFunded determines or reasonably suspects a violation, it may cancel trades, adjust account results, invalidate challenge progress, mark an account as breached, suspend or terminate accounts, withhold or deny payouts, cancel rewards or bonuses, require additional verification, restrict future access, and refuse refunds.

Unless expressly stated otherwise, all payments are final and non-refundable once a Challenge, product, account, dashboard access or trading environment is made available or once the user has commenced participation in the relevant Challenge or any simulated trading activity begins.

As a limited exception, AiXFunded may, in its sole discretion, consider a refund request submitted through customer support within twelve (12) hours after payment, provided that the user has not commenced the relevant Challenge or any simulated trading activity and the request does not involve fraud, abuse, restricted jurisdiction risk or rule violation. AiXFunded is not obligated to grant any refund.

No refund will be provided if you fail a Challenge, breach the Program Rules, violate these Terms, engage in prohibited conduct, are ineligible, are associated with a Restricted Jurisdiction, are blacklisted, submit inaccurate information, or send digital assets to an incorrect address/network.

If you initiate a chargeback, dispute, payment reversal or similar claim, AiXFunded may suspend or terminate your account, cancel Challenges, deduct amounts from rewards or balances, deny future accounts and recover related costs.

You are solely responsible for taxes, duties, reporting obligations and governmental charges arising from your payments, rewards, payouts, commissions or use of the Services.

AiXFunded may delay, suspend, restrict, cancel, reverse or refuse any payment, internal credit, refund, payout, reward, commission, account access or transaction where AiXFunded determines or reasonably suspects that such action is necessary or appropriate in connection with fraud prevention, cybersecurity, sanctions screening, wallet screening, anti-money laundering review, counter-terrorist financing review, compliance review, risk management, legal obligations, regulatory requests, service provider requirements, technical errors, platform errors or suspected prohibited conduct.

AiXFunded will not be liable for any loss, delay, missed opportunity, missed payout, missed commission, account restriction or other consequence arising from any such review, restriction, suspension, cancellation or refusal.

Rewards, performance rewards, bonuses, affiliate commissions and payouts are not guaranteed. All such amounts are subject to eligibility, Program Rules, platform records, risk review, payout review, compliance review, verification, sanctions screening, wallet review and AiXFunded approval.

For Standard Mode and Boost Mode, eligibility for performance-based payouts, payout calculation methodology, applicable payout ratios, payout conditions and other programme requirements are governed by the applicable Program Rules and product rules published by AiXFunded from time to time.

For Lite Mode, a user who successfully satisfies the applicable Lite Challenge conditions may become eligible to receive a fixed contractual reward, subject to the applicable Program Rules, product rules, verification procedures and AiXFunded's review and approval.

Payout-related internal credits may be added to the Account Balance before external payout. Account Balance payouts may be supported on scheduled dates, currently intended to be around the 8th, 18th and 28th of each month, subject to review, processing availability and platform changes.

AiXFunded may delay, reduce, deny, cancel, claw back or withhold any reward, performance reward, bonus, affiliate commission or payout if it identifies rule breach, prohibited trading, fraud, duplicate accounts, linked accounts, account sharing, affiliate abuse, restricted jurisdiction risk, sanctions risk, false information, platform error, technical error, payment issue, wallet issue or other risk concern.

AiXFunded may require additional verification before processing any payout, reward, bonus, commission or payout. Failure to complete verification may result in delay, denial or cancellation.

AiXFunded may, but is not obligated to, provide detailed reasons, evidence, internal risk analysis, trade review logic, fraud signals, wallet screening results, system logs or other internal information supporting any payout, reward, commission, bonus, payout, account or eligibility decision.

Any payout, reward, bonus, commission or payout that is approved or processed remains subject to later review, reversal, clawback, offset or adjustment if AiXFunded later determines that the underlying account, trade, referral, transaction, reward, commission or eligibility was invalid, erroneous, abusive, fraudulent, non-compliant or otherwise inconsistent with these Terms, the Program Rules, or the Affiliate Agreement.

AiXFunded may offer promotional campaigns, discounts, bonus credits, reward programs, Challenge credits, fee credits, Boost bonuses, referral rewards or other incentives from time to time. Promotional benefits are subject to the specific rules of the applicable campaign and may be modified, suspended or cancelled by AiXFunded at any time.

Unless expressly stated otherwise, promotional rewards are limited to one reward per eligible individual or account and may not be obtained through multiple accounts, aliases, related-party accounts, synthetic identities, third-party identities, coordinated activity, account merging, credit aggregation, referral manipulation or other circumvention methods.

AiXFunded may restrict, withhold, cancel, reverse or claw back any promotional benefit, reward, bonus, credit, commission or payout, and may suspend or terminate accounts, if AiXFunded determines or reasonably suspects any abuse, manipulation, fraud, "wool party" activity, bonus farming, referral abuse, account farming, campaign circumvention or violation of campaign rules.

Prohibited promotional abuse includes, without limitation, creating multiple accounts to benefit from first-time user promotions, using false or third-party identities to obtain rewards, coordinating with others to bypass eligibility limits, merging accounts or aggregating funds to re-qualify for promotions, exploiting campaign terms across multiple users, using scripts or plugins to bypass normal user behavior, or otherwise manipulating AiXFunded's systems, Services or campaigns.

AiXFunded has the final right to interpret all promotional campaign rules, eligibility requirements and reward entitlements. AiXFunded may, but is not obligated to, provide detailed reasons, evidence or internal risk analysis for campaign-related decisions.

Campaign-specific terms may apply and will prevail over these Terms in the event of conflict. No failure or delay by AiXFunded in enforcing any campaign rule will operate as a waiver of AiXFunded's rights.

AiXFunded may offer AI Agent features or AI Agent product variants. AI Agent features are experimental tools and may generate inaccurate, incomplete, delayed, unsuitable or unexpected outputs. AI Agent features do not provide financial, investment, legal, tax or trading advice.

If a product requires an AI reasoning score or other AI-related evaluation metric, such metric may be calculated according to AiXFunded's internal systems and Program Rules. AiXFunded may update scoring methodologies and risk controls from time to time.

You are responsible for understanding the rules applicable to manual trading and AI Agent trading. Trading method selections made at purchase may be locked through the Challenge.

AI Agent outputs, scores, recommendations and evaluations form part of AiXFunded's proprietary evaluation methodology and are provided solely for the purposes of the applicable Challenge. They should not be interpreted as predictions, recommendations or guarantees of future market performance or payout eligibility.

All websites, dashboards, software, simulations, trading environments, APIs, tools, data, designs, logos, trademarks, text, graphics, videos, documentation, risk systems, scoring systems, AI agent features and other content are owned by AiXFunded or its licensors.

You receive only a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial use in accordance with these Terms. You must not copy, modify, distribute, sell, rent, reverse engineer, scrape, decompile, interfere with or create derivative works from the Services.

Trade data, account data, program data, risk signals, scoring outputs and platform records generated through the Services may be used by AiXFunded for operations, risk review, compliance, product improvement, analytics, dispute resolution and enforcement, subject to the Privacy Policy.

Certain market data, pricing information and reference data displayed through the Services may be provided by or derived from third-party sources. Such data remains subject to the applicable rights of AiXFunded and/or the relevant third-party providers.

AiXFunded's collection and use of personal data is described in the Privacy Policy. By using the Services, you acknowledge that AiXFunded may process information including account data, wallet data, Telegram and X verification data, IP information, payment records, trading data, support data, affiliate attribution data, risk signals and compliance information.

You must not use the Services to collect, scrape, disclose or misuse personal data of other users. You must notify AiXFunded promptly if you suspect unauthorized access to your account or wallet.

If you post, submit or share content relating to AiXFunded, including testimonials, reviews, screenshots, videos, comments, community posts or trading content, you are responsible for ensuring that such content is accurate, lawful and not misleading.

Participation in the AiXFunded Affiliate Program is governed by the Affiliate Agreement. You must not make misleading claims, guarantee profits, guarantee payouts, imply that AiXFunded is legal in every country, impersonate AiXFunded, or promote AiXFunded to Restricted Jurisdictions, or represent that AiXFunded provides brokerage, securities dealing, investment management, investment advice, financial advice or other regulated financial services.

AiXFunded may remove, report or require changes to content that it considers misleading, harmful, unlawful, brand-damaging or inconsistent with official AiXFunded materials.

AiXFunded may suspend, restrict, terminate, blacklist, freeze or close your account, Challenges, Account Balance, rewards, affiliate access or payouts at any time if AiXFunded determines or reasonably suspects that you have violated these Terms, Program Rules, Affiliate Agreement, Privacy Policy, any applicable product rules or campaign rules or any applicable law, or if your activity presents legal, compliance, fraud, security, operational, reputational or business risk.

If AiXFunded suspects duplicate accounts, linked accounts, shared accounts, related-party accounts, same-person accounts, same-team accounts, suspicious IP/device patterns, suspicious wallet patterns, or similar abuse, AiXFunded may suspend related accounts, delay payouts, request additional verification, combine or analyze accounts together, cancel eligibility, deny rewards, close accounts and refuse refunds.

If you are blacklisted or banned, you must not create a new account or access the Services through another person, wallet, Telegram account, X account, device, IP address or entity.

AiXFunded may take action under this section where such action is connected to fraud prevention, cybersecurity, sanctions screening, wallet screening, anti-money laundering review, counter-terrorist financing review, regulatory requests, service provider requirements, risk management, legal obligations or suspected prohibited conduct.

Such action may include delaying, restricting, suspending, cancelling, denying or withholding access to the Services, Challenges, rewards, bonuses, commissions, payouts, affiliate access or other platform functionality, and adjusting, restricting or reversing entries in the Account Balance.

AiXFunded may also take any enforcement measure expressly contemplated by the applicable Program Rules, including force-closing simulated positions, adjusting Challenge results, invalidating Challenge progress or restricting participation in Challenges.

The Services are provided "as is" and "as available". AiXFunded makes no warranty that the Services, trading environment, dashboard, pricing feeds, account systems, AI Agent features, payout systems, risk systems or third-party infrastructure will be uninterrupted, error-free, secure, accurate, complete, available or suitable for your purposes.

AiXFunded does not provide investment, financial, legal, tax, trading or professional advice. None of the Services, platform content, trading data, AI Agent outputs, educational materials, market information, dashboard information, support communications, community messages, affiliate materials or statements by AiXFunded personnel constitutes investment advice, financial advice, trading advice, a recommendation, solicitation, offer or instruction to buy, sell, hold or trade any digital asset, derivative, perpetual contract or other instrument.

No employee, contractor, affiliate, community manager, partner or representative of AiXFunded is authorized to provide investment advice or trading recommendations on behalf of AiXFunded.

The Services are intended solely for evaluation, educational and simulation purposes. AiXFunded is not responsible for any trading, investment, wallet, DeFi, derivatives, copy trading, AI agent, automated trading or other activity you conduct outside the AiXFunded platform.

Digital assets, crypto markets, derivatives, perpetual contracts, leveraged products, simulated trading, trading strategies, blockchain transfers, smart contracts, wallets and network infrastructure involve significant risk. Past performance does not indicate future results.

You are solely responsible for your decisions, devices, internet connection, wallet security, private keys, tax obligations, legal compliance and understanding of applicable risks. You should seek independent professional advice if you do not understand the risks.

To the maximum extent permitted by applicable law, AiXFunded and its affiliates, directors, officers, employees, contractors, licensors, service providers, partners and agents will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, lost opportunity, trading losses, wallet losses, blockchain losses, missed payouts, missed commissions or business interruption.

AiXFunded will not be liable for any claims made against you by any third party arising out of or relating to your use of the Services, trading activity, wallet activity, promotional activity, affiliate activity, tax obligations, legal compliance, violation of third-party rights or breach of these Terms.

Any claim or cause of action arising out of or relating to these Terms or the Services must be brought within one (1) year after the claim accrues, otherwise such claim is permanently barred, to the maximum extent permitted by applicable law.

You agree to indemnify, defend and hold harmless AiXFunded and its affiliates, directors, officers, employees, contractors, licensors, service providers, partners and agents from and against any claims, losses, damages, liabilities, penalties, fines, costs and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Services, breach of these Terms, violation of law, violation of third-party rights, prohibited conduct, account misuse, wallet misuse, tax obligations, marketing claims, affiliate activity, breach of any applicable Program Rules, or any activity conducted through your account.

AiXFunded may modify these Terms, the Services, Program Rules, fees, products, payout rules, reward rules, Affiliate Program, restricted jurisdictions and platform features at any time. Changes may be made by posting updated terms on the website, dashboard, help center or through other communications.

Your continued use of the Services after changes become effective constitutes acceptance of the updated terms. If you do not agree, you must stop using the Services.

These Terms and any dispute, controversy or claim arising out of or in connection with these Terms or the Services are governed by and construed in accordance with the laws of the British Virgin Islands, without regard to conflict of law principles.

Before commencing any formal legal proceeding, the parties shall use reasonable efforts to resolve the dispute through good faith negotiations. Either party may provide written notice describing the dispute and the relief sought.

You irrevocably submit to the non-exclusive jurisdiction of the courts of the British Virgin Islands in respect of any dispute arising out of or relating to these Terms or the Services.

To the maximum extent permitted by applicable law, you agree to bring any claim arising out of or relating to these Terms or the Services solely in your individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, consolidated or similar proceeding.

Nothing in this Section shall prevent AiXFunded from seeking interim, conservatory, injunctive or other equitable relief in any court of competent jurisdiction where such relief is necessary to protect AiXFunded's intellectual property, confidential information, platform security, business interests or other legal rights.

To the extent permitted by applicable law, the prevailing party in any legal proceeding arising out of or relating to these Terms may recover its reasonable legal fees and costs as determined by the competent court.

AiXFunded will not be liable for any delay, failure, interruption, restriction, suspension, loss, damage, cost or expense arising directly or indirectly from any event or circumstance beyond AiXFunded's reasonable control.

Force Majeure Events include, without limitation, natural disasters, epidemics, wars, civil unrest, sanctions, embargoes, governmental or regulatory actions, court orders, cyberattacks, security incidents, blockchain congestion, blockchain forks, validator failures, RPC failures, oracle failures, smart contract failures, wallet provider failures, bridge failures, stablecoin depegging, exchange failures, liquidity provider failures, market data interruptions, pricing feed failures, power failures, internet failures, cloud provider outages, third-party service provider failures, or any delay, disruption, failure or malfunction of communication systems, computer systems, networks, trading systems, pricing systems, payout systems, risk systems or blockchain infrastructure beyond AiXFunded's reasonable control.

AiXFunded may suspend, delay, modify or cancel any Service, Challenge, payout, reward, commission, account access, product feature or platform operation affected by a Force Majeure Event.

These Terms, together with the Privacy Policy, Affiliate Agreement, Disclaimer, Program Rules, other product rules, Risk Disclosures, and any other documents incorporated by reference, constitute the entire agreement between you and AiXFunded regarding the Services and supersede all prior or contemporaneous agreements, understandings, statements or communications, whether oral or written, relating to the Services.

Any additional agreements executed or accepted by you in connection with specific products, payout, affiliate participation, campaigns, promotions or other services will be read together with these Terms. If there is a conflict between these Terms and a more specific agreement, the more specific agreement will control for the relevant subject matter.

These Terms are binding upon and inure to the benefit of the parties and their respective successors, assigns, legal representatives and permitted transferees.

AiXFunded may assign, transfer or delegate these Terms, any agreement, or any rights, claims or obligations arising from them, in whole or in part, to an affiliate, successor, purchaser of all or substantially all of AiXFunded's business or assets, acquirer, service provider, restructuring entity or other third party without your consent.

AiXFunded's failure or delay in exercising or enforcing any right, power, claim or provision under these Terms will not operate as a waiver of that right, power, claim or provision. Any waiver must be in writing and will apply only to the specific instance for which it is given.

No provision of these Terms will be construed against any party merely because that party or its representative drafted the provision.

If any provision of these Terms is held invalid, illegal or unenforceable, the remaining provisions will remain in full force and effect. The invalid, illegal or unenforceable provision will be interpreted or replaced to the maximum extent permitted by law to achieve the original intent as closely as possible.

Headings are for convenience only and do not affect the interpretation of these Terms.

Except as expressly provided in these Terms, a person who is not a party to these Terms shall have no right to enforce any provision of these Terms.

Any provisions which by their nature should survive termination, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnity, Governing Law, Dispute Resolution and Miscellaneous, shall survive termination of these Terms.

You acknowledge and agree that AiXFunded may communicate with you through the website, dashboard, platform notices, email, support channels, Telegram, X, or other contact methods associated with your account.

Electronic communications, including emails, dashboard notices, website notices, support messages and platform messages, will be treated as written communications and may satisfy any legal requirement that a communication be in writing, to the maximum extent permitted by applicable law.

You are responsible for keeping your email address, wallet address, Telegram account, X account and other contact information accurate and up to date. AiXFunded is not responsible if you fail to receive notices because your contact information is inaccurate, outdated, inaccessible, blocked or compromised.
